Terms of Service

Welcome to Subletopia. These Terms of Service ("Terms") govern your access to and use of the Subletopia website and services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. What Subletopia is

Subletopia is a search and discovery tool that indexes publicly posted sublet and temporary housing listings from third-party sources (such as public Facebook Groups, Marketplace, Kijiji, Craigslist, and similar platforms). Subletopia is an aggregator and directory. We do not own, operate, manage, list, broker, endorse, verify, or guarantee any property, listing, price, or counterparty. When you open a listing, you leave Subletopia and interact with a third-party platform and a third-party poster, subject to their terms.

2. No verification; do your own diligence

Listings are sourced automatically and may be inaccurate, outdated, duplicated, removed, or fraudulent. We do not verify the identity of posters, the existence or condition of any property, the accuracy of pricing, or the legality of any sublet. You are solely responsible for independently verifying any listing and for your dealings with any third party. Never send a deposit or money without confirming the listing is legitimate. Subletopia is not a party to any rental, sublet, or other agreement between you and a third party.

3. Eligibility and accounts

You must be at least 18 years old to use the Service. We use passwordless sign-in: you provide an email address and we send a one-time magic link. You are responsible for keeping access to your email account secure and for activity that occurs under your account. You agree to provide accurate information and to not impersonate any person.

4. Acceptable use

You agree not to:

• scrape, crawl, harvest, or bulk-export data from the Service;
• resell, redistribute, or create a competing product from our data;
• circumvent usage limits, paywalls, or access controls;
• disrupt or overload the Service, or attempt to access it by unauthorized means;
• use the Service for any unlawful, fraudulent, or harmful purpose.

5. Free and Premium plans; billing

The Service offers a free tier with usage limits (including a daily cap on the number of listings you can open) and a paid "Subletopia Premium" subscription that removes certain limits and unlocks additional features. Premium is available on a weekly or monthly billing cycle. Paid subscriptions are billed through our payment processor, Stripe, on a recurring basis until cancelled. You can cancel at any time through the billing portal; cancellation stops future renewals and your Premium access continues until the end of the current billing period. Except where required by law, payments are non-refundable, including for partial billing periods. Prices and features may change with notice.

6. Intellectual property

The Service, including its design, software, text, and branding, is owned by Subletopia and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes. Listing content belongs to its respective posters and source platforms.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any listing is accurate, available, or legitimate.

8. Limitation of liability

To the maximum extent permitted by law, Subletopia and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the Service, your dealings with any third party, or any listing. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or CAD $50.

9. Indemnification

You agree to indemnify and hold harmless Subletopia and its operators from any claims, damages, liabilities, and expenses arising out of your use of the Service, your violation of these Terms, or your dealings with any third party.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada.
